Is it legal to download YouTube thumbnails?

Why is there no HD (1280x720) option for some videos?
YouTube only generates the maxresdefault HD file when the uploaded video is HD and the thumbnail was rendered at full size. Older or low resolution uploads may top out at 640x480 or 480x360. PlayMETRIC always shows you the best sizes that actually exist.
